Decision Point: Repair Trust or Lose It Forever!

The Harkins v. United States decision, in addition to President Trump’s new executive order to reinstate the unvaxxed troops, represents a significant opportunity for the military to correct past injustices and restore trust in its leadership. The court’s ruling in the Harkin case exposed the Coast Guard’s failure to fairly evaluate religious accommodation requests, as well as the Coast Guard’s unlawful mandate for servicemembers to be injected with an Emergency Use Authorization (EUA) gene therapy agent, deceptively called a “vaccine.”

 

President Trump’s executive order now provides clear directives for redress: mandated reinstatement, restoration of back pay and rank for service members who were unjustly discharged. If the military is truly committed to upholding the rule of law and honoring those who have dedicated their lives to service, it must act swiftly and comprehensively to implement these measures. The blanket denial of religious exemptions and the coerced separations for refusing an experimental injection have undermined the principles of fairness and due process—principles the military is sworn to uphold.

 

Whether the military will do the right thing, however, remains uncertain. Bureaucratic resistance, institutional pride, and potential financial implications may hinder full compliance with the executive order. Military leadership might argue that reinstatement disrupts operational readiness or that back pay imposes an undue burden on the budget. Yet, these concerns do not outweigh the moral and legal imperative to correct wrongful and even unlawful separations. The executive order provides a framework to ensure that those who were forced out unfairly can return to service without penalty, reinforcing the principle that service members should not be punished for standing by their deeply held convictions or attempting to comply with customary UCMJ regulations and the US Constitution.

 

The military’s response to this Presidential Executive Order will ultimately serve as a test of its integrity. If it chooses to implement these provisions in good faith, it can begin to rebuild the trust lost due to the unlawful COVID shot mandate and deeply flawed enforcement.  Failure to fully implement the Presidential Executive Order would only deepen distrust between service members and leadership, further eroding confidence in military institutions, which in turn reduces urgently needed retention and recruiting to maintain military readiness.

 

True leadership requires the humility to admit past mistakes and take meaningful steps to rectify them. If the military drags its feet or offers only partial compliance, it will send a clear message that service members’ rights can be disregarded whenever convenient. That will forever damage morale, and the ability to attract recruits and retain highly trained service members, which in turn is seriously damaging the national security of the United States.

 

Our volunteer military service members deserve better. The question now is whether the military will follow through on the promise of justice—or if it will allow institutional corruption to stand in the way of doing what is right.  Americans need to make our voices heard throughout the halls of Congress and across all our social media channels that our military service members must be honored, and their Constitutional rights upheld.
